Terms of Service

These terms govern your use of software and services provided by The Big North Company, an independent software studio registered in England & Wales ("we", "us"). By using our products, you agree to these terms.

Licence

Subject to these terms, we grant you a personal, non-exclusive, non-transferable licence to use our software. Where a product is open-source, the applicable open-source licence governs the source code, and these terms govern the hosted services and paid features we provide.

Your content

You retain all ownership of the content you create with our products. We claim no rights over it. Because our products are local-first, your content remains under your control on your own devices unless you choose to use optional sync or hosted features.

Acceptable use

You agree not to use our products to break the law, infringe others' rights, or attempt to disrupt or compromise our services or other users.

Purchases and licences

Paid licences and subscriptions are described at the point of sale. Purchases made through the Apple App Store are also subject to Apple's terms. Refunds for App Store purchases are handled by Apple under its policies; for purchases made directly through us, contact us and we will deal with your request fairly and in line with applicable consumer law.

Warranty and liability

Our products are provided "as is" to the fullest extent permitted by law. We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence. Subject to that, we are not liable for indirect or consequential loss arising from your use of our products.

Changes

We may update these terms from time to time. Material changes will be reflected by the "last updated" date above, and continued use after changes constitutes acceptance.

Governing law

These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections in your country of residence.
